Residents comment Part 3 and 4
There were
many questions for the embattled Supervisor at the monthly meeting last night
concerning his failure to pay his sewer district application fee on time last
April 2017. Two local stations were present, channels 6 and 9 and that did not
please the Supervisor.
Residents
asked the obvious questions.
Why was the
check submitted to the town 18 months after it should have been submitted?
Why was it
for $1850 instead of the fee established by the town board of $2100?
Why did
neither the Comptroller or head of the Building Dept do nothing to collect that
fee?
After
acknowledging that the missing payment was discovered because of the August 10,
2018 FOIL, there was no explanation for the checks date and that of the town
record accepting it as August 7th, 3 days before they say they knew
it was not paid.
How much if
anything did the Supervisor pay the town engineer to complete his design map?
If he paid
nothing it is yet another example of the Supervisor using his position for
personal financial gain as this work usually costs around $2000.
Did he pay
the Town Engineer to do his map and if so how much?
If the Supervisor paid nothing for the
engineering map he appears to be in violation of General Municipal Law Article 18
S 805A :
1. No municipal officer or employee shall: a. directly
or indirectly, solicit any gift, or accept or receive any gift having a value
of seventy-five dollars or more, whether in the form of money, service,
(ETC)loan, travel, entertainment, hospitality, thing or promise, or in any
other form, under circumstances in which
it could reasonably be inferred that the gift was intended to influence him, or could reasonably
be expected to influence him, in the performance of his official duties or was
intended as a reward for any official action on his part;
Also this
appears to be in violation of the Ethics Law
S13-5 No Town employee shall accept
other employment which will impair his independence of judgment in the exercise
of his official duties.
C. No Town employee shall use or attempt to use his
official position to secure unwarranted privileges or exemptions for himself or
others.
J. Each
Town employee is prohibited from accepting gifts or gratuities of more than
nominal value where the
circumstances would permit the inference that:

(1) The
gift was intended to influence the individual in the performance of official
business; or
(2) The
gift constituted a tip, reward, or sign of appreciation for any official act by
the employee.
Article 18 S 805 Any municipal officer or employee who willfully and knowingly
violates the foregoing provisions of this article shall be guilty of a
misdemeanor.)
At the beginning of Residential comments Part 4 you will hear Desso say he paid LaBerge engineering their fee but when questioned he refused to say how much he paid them. That's a man hiding something, it's called free services from a town consultant. Value, approximately $2000.

This final segment is a board discussion of the failed fee collection process. Finally a couple of Lou Desso's board allies stood up a little with some push back. It's a start and a sign they see the rising tide against the Supervisor. Lastly, while it is not filmed here, town resident Karl Yager called on Desso to resign or not run again. Guess he's had enough.

One word for both Supervisor and Building Dept Coordinator
Malfeasance. Intentional conduct that is wrongful or unlawful, especially by officials or public employees. Malfeasance is at a higher level of wrongdoing than nonfeasance (failure to act where there was a duty to act) or misfeasance (conduct that is lawful but inappropriate).
